I believe smokers have a case here of prohibited discrimination…what say you?
Here is an example of prohibited employment discrimination:
Alpha Production Company needs to hire entry-level laborers. The job requires heavy lifting and physical exertion, but does not require any technical skill. Alpha Production believes that all of its employees should have a high school diploma. So the company does not consider applicants who did not finish high school for the laborer job.
The high school diploma requirement disqualifies a greater number of Hispanic candidates for the laborer job at Alpha Production than Non-Hispanic White candidates. According to the most recent Census data, in the counties from which Alpha Production draws its applicants for laborer jobs, 94.2% of the white population 18 years and older has completed high school, but only 46.9% of the Hispanic population 18 years and older has completed high school. Alpha Production could not provide a business justification for using the high school diploma requirement. Thus, Alpha Production has engaged in prohibited discrimination.

First, to call this insanity is to put it mildly; nonetheless, sadly it IS government law in this country today as stated in the Guide for Small Businesses with Federal Contracts referenced above.
We here at BtBWI support small businesses and their right to choose, correct? Well, seems to me this company should have the right to choose if it wants to hire people that, at the very least, have a high school diploma. Yet, our government promotes hiring the ignorant all in name of “prohibited discrimination”.
Where am I going with this?
Apply this to smokers. Let’s say “Alpha Productions” is also required to have a non-smoking policy among their workers.
Okay, according to the American Heart Association, 32.2% of the adult Hispanic population over 18 smokes.
Forty-four percent of adult whites smoke.
(Stats: http://www.americanheart.org/presenter.jhtml?identifier=4559 )
So, if a non-smoking rule were to apply, you would be taking out 32.2 percent of the hispanic population for job eligibilty.
But you’d be taking out 44 PERCENT OF THE ADULT WHITE POPULATION! For doing something legal…
The requirement disqualifies a greater number of whites than hispanics.
“Prohibited discrimination”!

Yes, but you’re forgetting something – the protections of law do not apply to us. We are less than full citizens. We are less than human. Basic human dignity does not apply to us. We are the new niggers. If we had any decency at all we would just kill ourselves so that decent folks wouldn’t have to tolerate our presence on their earth. We are lower than child molesters. We are worse than people who fly airplanes into buildings. We are a blight upon society.
DUH! Of course Mr. Blues, how could I forget? I guess that part hasn’t totally sunk in…my bad.
